Terms of Service for the Notoq Discord Bot
1. Contracting Parties & Subject Matter
1. Free Usage:
When using the Notoq Bot in the free basic version, the usage agreement is concluded directly with us:
Notoq, Owner: Julian Maschke, Fährstraße 217, 40221 Düsseldorf.
2. Premium Services (Purchase Agreement):
When booking paid premium features ("Premium", "Supreme"), our authorized partner Paddle.com Market Ltd. acts as "Merchant of Record" (reseller).
This means: Your contracting party for payment, invoicing, and tax processing is Paddle. We (Notoq) are merely the technical service provider.
The use of our services is permitted for persons who have completed their 13th year of age. Minors require the consent of their legal guardians.

3. Accessing Current Information
The provider maintains an information channel (e.g., in the #news or #announcements channel) on the support Discord server (Join Discord Server) for current information about offers, promotions, and changes.
The provider's offers covered by these terms of service cannot be used without a Discord account.
4. Services and Features
The provider offers users a service for Discord servers in the form of a Discord bot ("Notoq"). The offered service includes certain features (e.g., statistics, moderation, community tools) and may be extended by additional web services (such as this website/dashboard).
Currently offered features can be viewed on our website. New features may be added without prior notice. Existing features may be modified.
For significant upcoming changes or discontinuation of features, the provider will inform you at least 24 hours before the changes take effect via the information channel.
5. Availability & Liability
We strive for a service availability of 99% on an annual average. This excludes maintenance work and downtime beyond our control.
Where products or subscriptions are offered as "Lifetime", this term refers to the lifetime of the product (as long as the "Notoq" service is technically provided by the provider) and not to the buyer's lifetime. Should the operation of the Notoq bot be permanently discontinued, the usage right ends at the time of service discontinuation.
Dependency on Third Parties (Discord):
The Notoq bot is technically dependent on the Discord platform (Discord Inc.). We are not liable for malfunctions, data loss, or outages attributable to changes in the Discord API, Discord server issues, or bot blocking by Discord.
Should the premium service fail permanently (over 48 hours) due to such external reasons, you are entitled to a pro-rata refund for the outage period. This must be requested through Paddle.
6. Right of Withdrawal for Consumers
If you are acting as a consumer, you have a statutory right of withdrawal when concluding a paid premium service agreement.
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of contract conclusion.
Since the purchase is processed through our "Merchant of Record" Paddle.com, you may need to direct your withdrawal directly to Paddle (e.g., via their support links in the purchase email) or to us (Notoq, Owner: Julian Maschke, Email: contact@notoq.xyz). Learn more here.
Expiration of the Right of WithdrawalFor contracts concerning the delivery of digital content, your right of withdrawal expires prematurely if you expressly agree during the purchase process (in the Paddle checkout) that the execution of the contract shall begin before the expiration of the withdrawal period, and you confirm your knowledge that you thereby lose your right of withdrawal.
7. Premium, Payment & Cancellation
The following conditions of our partner Paddle apply to paid subscriptions:
- Payment: Billing is done in advance for the selected period (e.g., monthly/annually). The contracting party for payment is Paddle.
- Automatic Renewal: Subscriptions renew automatically unless canceled before the end of the current period.
How can I cancel?
You can cancel your subscription at any time at the end of the term. The easiest way to do this is through Paddle's support portal:

8. Promotional Vouchers
A promotional voucher is a voucher issued free of charge (e.g., as part of a promotion).
- Redemption is subject to the conditions communicated at the time of issuance (e.g., validity period, frequency of use).
- Combining multiple promotional vouchers is generally not possible.
- Cash payment or transfer to third parties is prohibited.
9. Usage Rights & Obligations
The use of the provider's services is permitted for private and commercial purposes.
It is not permitted to reverse engineer the Notoq bot or other services and software of the provider or otherwise attempt to derive the source code. Users may only use services as intended.
The provider enables users to send messages on Discord servers through features (e.g., embeds, auto-messages). The provider is not responsible for this content. Liability rests solely with the user.
10. Code of Conduct
Users must refrain from the following actions when using the provider's services:
- Violations of Discord's Community Guidelines or Terms of Service.
- Sending advertising of any kind (spam) via the bot.
- Using the provider's interfaces (APIs) without express permission or engaging in "scraping".
- Abusing the bot or the provider's services.
- Activities that harm security (phishing, malware, DoS attacks).
- Organizing the sale of regulated or dangerous goods.
- Organizing illegal gambling or other unlawful activities.
Violations may result in immediate suspension. Please report incidents on our Discord server through the ticket system.
11. User Content
When using the services, users can upload their own content (e.g., in embeds, backup functions, configurations).
This content belongs to the user. However, the user grants the provider a license when submitting content. This license includes using the user's content in connection with operating, developing, and improving the services (e.g., storing, copying, modifying/formatting, and displaying).
The user must ensure that they are authorized to grant this license and that the content complies with applicable law. This license is worldwide, non-exclusive, royalty-free, and perpetual (as long as necessary to provide the service).
The provider reserves the right to block or remove content if it violates these terms.
11a. Reviews & Server List
1. Review Guidelines:
Users can rate servers. We reserve the right to delete reviews without warning if they:
- Are demonstrably false or constitute "review bombing".
- Contain advertising, spam, or nonsensical character strings.
- Contain insults, hate speech, or private information.
- Serve to artificially manipulate a server's rating.
2. Server Ranking & Recommendations:
The order of servers in lists ("Trending", "Popular") is based on automated algorithms considering factors such as member count, activity (voice/chat), and ratings. We assume no responsibility for the accuracy of information in server profiles, as these are managed by server administrators.
3. External Links:
By clicking the "Join" button, you leave our service and are redirected to Discord. We have no control over the content of linked Discord servers.
12. Content Guidelines
The following content is not permitted when using the services:
- Harassment, bullying, or sexual harassment.
- Threats or incitement to violence.
- Disclosure of personal data without consent (doxxing).
- Hate speech and discriminatory statements.
- Glorification of violence or extremist content.
- Sexual content, especially involving minors (strictly forbidden).
- Content promoting self-harm or suicide.
- Dissemination of false or misleading information (disinformation).
- Content violating copyright.
13. Dispute Resolution
We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.
14. Changes to Terms of Service
We reserve the right to change these terms of service at any time. Significant changes will be announced via our website or the information channel on our Discord server (at least 14 days before taking effect).
Continued use of the bot after a change is considered acceptance of the modified terms. If the user has an active subscription, they have the right to cancel on the date the changes take effect.
